Sports Bill

In order to bring transparency and accountability in the functioning of the National Sports Federations and Indian Olympic Association , the Government is introducing Sports bill and is formulating a regulatory framework with the objective of promoting good governance among sports bodies. The Draft of the National Sports Bill has been placed in the public domain for pre-legislative stakeholders consultations. Following are the salient features of the proposed National Sports Development Bill, 2011:-



a) Central Government support for development and promotion of sports including financial and other support for preparation of National teams, athletes’ welfare measures and promoting ethical practices in sports including elimination of doping practices, fraud in age and sexual harassment in sports, Rights and obligations of the Indian Olympic Association and National Sports Federations (including adoption of basic universal principles of good governance and professional management of sports). 

b) Participation of athletes in the management/decision making of the concerned National Sports Federation and the Indian Olympic Association through the Athletes Advisory Council. 

c) Duties and responsibilities of the Sports Authority of India and the Government of India, which have been clearly defined. 

d) Mechanism for sports dispute settlement and establishment of a Dispute Settlement and Appellate Tribunal. 

e) Greater autonomy to National Sports Federations and dilution of control of Government over the National Sports Federations. 

f) Bring National Sports Federations under Right to Information Act, 2005 with certain exclusion clauses for protecting personal/confidential information relating to athletes. 

g) Specific provision has been inserted in the anti-doping clause to exclude the administering by the National Anti Doping Agency (NADA) of those provisions of the World Anti Doping Agency (WADA) Code to which the International Federation of the Sport is not subject. 

h) A duty has been enjoined upon the coaches, guardians and other support personnel to prevent unethical practices in sports such as doping and fraud of age. 

i) Specific provisions have also been made to ensure that National Sports Federation, the National Olympic Committee, the Sports Authority of India adopt or undertake measures not only to prohibit sexual harassment at workplace for sports but also provide appropriate conditions for women in respect of work, leisure, health and hygiene. Other measures have been provided for setting up a complaint mechanism for redressal of complaints with a committee headed by a woman, or a special counselor, whilst adhering to the principle of confidentiality.

मोची

मुंबई स्थित मलाड स्टेशन के बाहर बैठने वाला एक मोची मेरे लिए पिछले 4 महीनों से कौतूहल का विषय बना हुआ था। 4 माह पूर्व मैंने मलाड स्थित एक कंपनी में नौकरी ज्वाइन की थी, यद्यपि मेरी पिछली नौकरी की तुलना में वेतन यहां कुछ कम था परंतु महत्वपूर्ण बात यह थी कि यह मेरे निवास स्थान बोरीवली से बहुत ही नज़दीक था जिसकी वजह से मुझे सुबह एवं शाम दोनों वक्त स्वयं के लिए समय मिल जाता था। मेरी अन्य आदतों में एक बहुत ही गैर जरूरी आदत यह रही है कि मैं रोज ऑफिस जाने से पहले अपने जूते मोची से पॉलिश करा कर जाता रहा हूं। ऑफिस का वक्त 9:30 बजे प्रारंभ होता था और मैं सामान्यता 9:15 बजे मलाड स्टेशन पर उतर कर अपने जूते पॉलिश कराने के पश्चात 9:25 बजे तक ऑफिस पहुंच जाया करता था। नई नौकरी ज्वाइन किए हुए करीब 1 हफ्ते का वक्त गुजरा होगा मैं रोज की तरह स्टेशन से उतर कर जिस जगह कतार में 5-6 मोची बैठे रहते थे उस और अपने जूते पॉलिश कराने के उद्देश्य से गया। आज मैं समय से थोड़ा पहले निकला था, वक्त करीब 9:00 बज रहे थे मैंने देखा की बाकी सभी मोची व्यस्त थे एवं एक थोड़ा अलग सा दिखने वाला मोची अभी अभी तुरंत ही आया था। उसे ख...

शब्द हैं विचार हैं । शब्दों में विचार है, या विचारों में शब्द है । कभी विचार हैं तो शब्द नहीं, और कभी शब्द हैं तो विचार नहीं । न विचार सदा रहे बंधे, शब्दों के जाल में । न शब्द सर्वदा रहे, विचारों के प्रभाव में । शब्द जो निशब्द है, विचार सब व्यर्थ है । विचार जो भ्रांत है, शब्द सब निरर्थ हैं । उपयुक्त विचार अयुक्त शब्द, युद्ध का प्रारब्ध है । कुटिल विचार मृदु शब्द, विध्वंस का आरम्भ है । शब्द व विचार के इस युद्ध को विराम देकर । विचारों के सागर से शब्दों के मोती निकालकर , उन मोतियों को विचारों के धागों में पिरोने वाला । जिसने इनका निष्कलंक संतुलन है पाया, वही उत्तम मनुष्य है कहलाया ।

Guidelines for Lie Detection / Narco analysis / Polygraphy etc Test

Supreme Court in Smt Selvi & Ors vs State of Karnataka (Criminal Appeal No. 1267 of 2004) on 5th May 2010 held that:  No individual should be forcibly subjected to any of the techniques in question, whether in the context of investigation in criminal cases or otherwise. Doing so would amount to an unwarranted intrusion into personal liberty. However, the court allowed voluntary administration of the impugned techniques in the context of criminal justice, provided that certain safeguards are in place. Even when the subject has given consent to undergo any of these tests, the test results by themselves cannot be admitted as evidence because the subject does not exercise conscious control over the responses during the administration of the test. However, any information or material that is subsequently discovered with the help of voluntary administered test results can be admitted, in accordance with Section 27 of the Evidence Act, 1872.
